MarketplaceHospital Safety Signs Has anyone successfully tackled the California DMV trying to get a safety flag removed from his file? I had a seizure in 1995 - the only seizure of my life. California DMV waited two years before the suspension of my license as a result of the seizure (hospitals are mandatory reporters and was transported by ambulance to the hospital). In 1997 I moved to Washington and tried to get my license, but I was told I could not because the CA had my license suspended. It was the first time I discovered that my license was suspended. With two years and many phone calls to CA DMV later, I was finally able to get my license in Washington in 1999 as AC finally raised the flag of the safety of my back and lifted my suspension . I went back to HQ and tried to get my license and have tried unsuccessfully for 3 years now to get CA to remove the flag again, because they say it is still there. They require a form to be signed doctor, but I did not have insurance and I consulted a doctor will not sign until I made tests that cost $ 1,600 in total. Everyone has fought successfully DMV here? If yes, how? The burden is on the DMV to prove the grounds for the suspension prior to the deprivation of your right to drive. You should not have to pay $ 1,600 to prove you should get this right of return, for the suspension of the DMV in the first place had no procedure for due process. That's my point of view, you should have no recourse. They must give you a hearing before making their decision in the first place. You can use a brief, but it will take more than three months. They know that we must all take longer possible alternative, and that is why they continue to do so. Report Abuse Posted on August 7, 2010.
