Hospital Safety Signs

Hospital Safety SignsHas anyone successfully tackled the California DMV trying to get a safety flag removed from his file?

I had a seizure in 1995 - the only seizure of my life. California DMV waited two years before the suspension of my license as a result of the seizure (hospitals are mandatory reporters and was transported by ambulance to the hospital). In 1997 I moved to Washington and tried to get my license, but I was told I could not because the CA had my license suspended. It was the first time I discovered that my license was suspended. With two years and many phone calls to CA DMV later, I was finally able to get my license in Washington in 1999 as AC finally raised the flag of the safety of my back and lifted my suspension . I went back to HQ and tried to get my license and have tried unsuccessfully for 3 years now to get CA to remove the flag again, because they say it is still there. They require a form to be signed doctor, but I did not have insurance and I consulted a doctor will not sign until I made tests that cost $ 1,600 in total. Everyone has fought successfully DMV here? If yes, how?

The burden is on the DMV to prove the grounds for the suspension prior to the deprivation of your right to drive. You should not have to pay $ 1,600 to prove you should get this right of return, for the suspension of the DMV in the first place had no procedure for due process.

I have no special knowledge regarding seizure of suspensions, but generally the DMV will summon you to a hearing and only after the suspension hearing may be lawfully applied.

The only exception that comes to mind is that if you live in the wrong address and thought that since you're moving at the end of the year in any case what is the point of paying $ 26 to DMV for an address correction. The DMV had issued the summons to the wrong address and found you had given automatically to your rights without a hearing. This should not be legal either, but I do not know anyone who has fought successfully against the DMV on it.

What is your intention? I mean of course you need to drive, but would you be willing to replace the price of a doctor for the cost of a lawyer? Counsel for the DMV is the Attorney General, who is financially by all the money in California. How can you pay your lawyer? I'm afraid to say that most people do the wrong thing here, because even though life is fair, they lose the battle now hoping they can win the war later.

I wish I could say something more inspiring than the American revolutionaries. If I do not come back with something else, then I leave you with this final thought. You're not alone, while the government may have our money, we have our numbers. I ask you, which is stronger?

* / End of line.

That's my point of view, you should have no recourse. They must give you a hearing before making their decision in the first place. You can use a brief, but it will take more than three months. They know that we must all take longer possible alternative, and that is why they continue to do so. Report Abuse
